Horrible analogy here is one that works.

It is like jailing a planker because he made a trend and people started dying indirectly due to being dumb (It has happened)

A perfectly smart thing to do it is actually called setting a precedent. In a society obeying the laws of punishment (Which of course a forum will never do properly) You must first be banned for subsequent offenders to be punished unless you have been absolved already.
