If the Vistawinia currently sold includes all the features tested, the NDA wouldn't be breached - the beta tester just has to show that either they received the information from a source other than IV and other beta testers or that the information was already known publicly.

In Testrie's defence, I found out about the Jailbreak level from one of the press releases. Google returns hundreds of news hits. But NDAs are serious business, so Testrie shouldn't be teasing people with "*******" stuff.
